General Information
- If you have received a citation and believe it was issued in error, we encourage you to submit an appeal.
- All appeals must be filed with the Business Office in writing within(10) business days after notice of the violation.
- If you are uncertain about Indiana University's parking rules and regulations, click on regulations to review them.
Appeals Guidelines
- Read these guidelines carefully before completing your appeal.
- Ignorance of the regulations is not an excuse. The driver is responsible for knowing the regulations, which are available online.
- A parking permit is not a guarantee of a parking space. The driver is responsible for finding an authorized parking space. The lack of a space does not justify a parking violation.
- Any student, faculty or staff member must register their vehicle to drive or park on University property. Parking permits must be displayed according to the parking regulations to be considered valid.
Appeals Committee (who reads the appeals once they have been submitted)
- The Finance and Administration Appeals Committee was established by IUPUC to provide parking patrons with an avenue for appeal. The Committee members, consisting of IU students and Staff, are appointed by the Bursar and consider written appeals for reducing fines or waiving penalties.
- The Bursar (or designee) is responsible for providing copies of all appeals and other information regarding such appeals for the Committee's review. The Bursar is permitted to attend all appeals meetings, but is not allowed to vote on appeal decisions.
- The Parking Assistant and/or Bursar communicates the decisions of the Committee to the appellant.
- The decision of the Committee is final, and a violation may not be re-appealed unless significant new evidence or proof is submitted.
Please note - The Appeals Committee uses the following guidelines to reach a decision.
- When you become a student or accept a position with IU, you agree to abide by the rules and regulations established by the University.
- Your past parking record will be a factor in the decision.
- Ignorance of the regulations isnot an excuse. The driver is responsible for knowing and abiding by the parking rules and regulations.
- A parking permit is not a guarantee of a space. Not only is the driver responsible for finding an authorized space, but the lack thereof does not justify a parking violation.
- The registrant of the vehicle is responsible for any ticket assigned, regardless of who is driving the vehicle at the time of the violation.
- Students, faculty and staff must register their vehicles to drive or park on campus. Parking permits must be displayed correctly to be considered valid.
Appeals Process
- Appellant submits an appeal.
- The citation in question is marked on the appellant's account to show it is on appeal. This annotation prevents the appellant from being billed until the Parking Appeals Committee reaches a decision.
- The Parking Appeal's Committee reads the appeal and renders a decision.
- The committee's decision is e-mailed to the appellant.
- If the appeal is denied, the appellant is billed.
Grounds for Appeal
Appeal only when you have valid grounds. Limit your appeal to the circumstances in which the parking ticket was issued in error, i.e., you did not commit a violation. If the facts show that you committed a violation of parking rules, your appeal will be denied regardless of the reason or excuse.
Examples of seldom granted petitions
- Lack of knowledge of the regulation such as new to campus or have not reviewedregulations
- Lost the citation
- Forgetfulness
- Parked only for a short time
- Inability to find a legally marked parking space
- Had the wrong permit for the space used
- Failure to obtain a temporary permit
- Did not see a parking sign
- Left my permit hanging in my other car
- Other vehicles were also parked improperly
- Late to class or appointment
- Disagreement with or inability to pay the amount of the fines
Reasons for Granting an Appeal
Appeals may be granted for two reasons:
- There is substantial evidence the appellant did not commit the violation for which the citation was issued.
- The appellant may have committed the violation, but circumstances were not under theappellant's control, and
- prior to being issued the ticket, s/he made some demonstrable attempt to notify the Business Office or Maintenance of the situation, or
- can produce written verification form a source who was a party to the situationestablishing that the situation was so unusual it cannot reasonably occur again.
Recommended Format
Your appeal should be typed or neatly written. Please include the following information:
- Your full name
- Postal address
- IU Student or Employee ID number
- A copy of the citation
You may submit the appeal either on-line with your ticket number, or use the appeal form available in the Business Office.
Format of Your Explanation
- Describe the facts of the matter. List the circumstances: when the incident occurred, where it occurred, and how or why it occurred.
- If an emergency or other extenuating circumstances are presented as cause for appeal, supporting documentation should be attached to the form (e.g., accident reports, medical records, auto repair bills).
- Enclose a photograph, map or diagram of the parking space in question, if you believe it will help the Appeals Committee understand the basis of your appeal.
- Explain how your action did not constitute a violation by applying the parking regulation in question to the facts you have discussed.
Remember - The issue in your appeal is not whether the parking regulations are fair, but whether you violated those regulations.
